UAE Labour Law

What gratuity are you owed?

End-of-service benefits under Federal Decree-Law No. 33 of 2021, the law in force since February 2022. Enter your basic salary and your dates.

Your employment

The basic wage on your contract. Not the total package — housing, transport and other allowances are excluded by law.

Unpaid leave, part-time hours and dismissal

Unpaid leave does not count towards your period of service.

Leave at 100 for a full-time contract. Part-time and flexible contracts are paid a proportion of the full-time entitlement.

Your estimated gratuity

Enter your basic salary and start date and the figure appears here.

How it is calculated

Gratuity is worked out on your basic wage, not your total package. Housing, transport and other allowances are excluded, which is why the figure is often lower than people expect from their gross salary.

  • One year minimum. Complete a continuous year and you are entitled. Below that, nothing is due.
  • 21 days a year of basic pay for each of the first five years.
  • 30 days a year for every year after the fifth.
  • Part years count, pro rata, once the first year is complete.
  • Capped at two years' wage, however long you served.
  • Unpaid leave does not count towards your period of service.

Resigning no longer reduces it

Under the previous law, an employee who resigned before completing five years lost a third or two thirds of their gratuity. That reduction was removed when Federal Decree-Law 33 of 2021 came into force in February 2022.

If you have completed a year, you are owed the same whether you resigned or your contract ended for another reason. Many calculators still apply the old scale and will tell you that you are owed considerably less than you are.

Where this does not apply

DIFC and ADGM run their own employment regimes. DIFC replaced end-of-service gratuity with DEWS, a funded savings scheme paid into monthly, so what you are owed there is a fund balance rather than a figure derived from your final salary. This calculator does not apply to either free zone.

Service that began before February 2022 can be more involved, because entitlement accrued under the previous law is preserved. The figure here uses the current rules throughout.

Dismissal under Article 44 — the gross-misconduct grounds — can forfeit gratuity entirely. Whether it applies to a particular dismissal is a legal question.

Your employer may also deduct amounts you owe them, and unpaid leave, notice and accrued annual leave are settled separately from gratuity.
